After making a huge mistake by eliminating the AB48 exemption for all of the state’s flight schools and instructors, the legislator passed this corrective bill and the governor signed it. We appreciate their work to correct this mistake.

I read your article regarding the $5,000 application fee for the BPPE – are you aware of the audit cost as well? We’ve had an estimate of $50,000. Here is my letter to them – just want to share and vent with someone who feels the same way.
Editor’s Note: The “one size fits all” mentality of the state legislature affects all small businesses, including of course, flight schools. Please take the time to read this letter to BPPE from the RN Director of Nursing Professional Medical Careers Institute to understand what this ill advised legislation really costs.The question needs to be asked – Does California really need BPPE – or is this a typical method the legislature uses to keep lucrative paying state jobs?

A quick update on AB 48, The California Private Postsecondary Education Act of 2009.
In an email, Kyle Precourt, (Field Representative Office of Assemblymen Martin Garrick) has said that he is currently working with Assemblyman Garrick’s Legislative Director, Joe Patterson, and other legislative offices in Sacramento to obtain relief for flight schools.

California passes requirements for flight schools
Calif. Gov. Arnold Schwarzenegger signed Assembly Bill 48 into law last fall, which mandates FAA-approved flight schools satisfy certain requirements. Called the California Private Postsecondary Act of 2009, the law will require flight schools to pay a yearly fee (i.e., more taxes ….Ed) and open their books to regulators. A hearing about how to implement the law is set for June 7.

But The Effort Will Be Expensive, And A Win Is Not A Sure Thing
On Monday June 7th, about 50 concerned flight school owners and flight instructors traveled to Sacramento, CA for the Bureau for Private Post-secondary and Vocational Education (BPPE) hearing, and to plead their case for exemption from (AB) 48. While the flight school owners and instructors presented a united front to fight what could be an industry crippling or killing piece of legislation, they were not encouraged by the outcome.

If you haven’t already heard, Sacramento is at it again.
Last year AB-48 was quietly passed without much attention from the general aviation community – mostly because we were not aware we needed to be concerned. AB-48 is a reinstatement of another consumer protection law which had rightfully expired.
