Good Airport News from the California Attorney General

Report by the CALIFORNIA PILOTS ASSOCIATION, The Airport Advocates

Good Airport News from the California Attorney General. A great big ATTABOY to Riverside County Deputy County Counsel B.T. Miller. At his request the California Attorney General issued an opinion very favorable to airport preservation. As legal counsel to the Riverside County Airport Land Use Commission, Mr. Miller became aware of a flaw in local airport compatibility planning. A previous Airport Land Use Commission had adopted a policy of exempting specific plan projects from requirements of airport land us plans. This allowed incompatible projects to be built near the county airports. The question posed by Mr. Miller to the attorney general was: Can an ALUC legally exempt a specific plan project from the requirements of a comprehensive land use plan? The answer by the attorney general was NO!
