The California Supreme Court issued a decision June 21st that will have a significant impact on future airport land use planning in California. In 2002 the Solano County Airport Land Use Commission (ALUC) updated its Travis Airport Land Use Compatibility Plan (TALUP). A developer, Muzzy Ranch Company (Muzzy), filed a lawsuit to invalidate the plan. In its deliberations the Court interpreted the California Aeronautics Law, the California Environmental Quality Act and the public housing law before ruling that the TALUP was valid.

This is a request for assistance in preserving California’s public airports and the California Airport System Plan. The request is made as a result of a recent action by the City of Tulare that approved construction of a trucking terminal in the Runway Safety Zone of the Tulare Airport.

PILOTS WIN A ROUND IN COURT

Tulare Airport supporters won an important point in court September 30, 2005 when Superior Court Judge Melinda Reed ruled that the City of Tulare had not complied with state law. The California Pilots Association (CalPilots) had filed a lawsuit in 2004 to protect the airport after the City Council had taken action threatening the airport.
